Court makes fresh pronouncement over Tinubu’s certificate

……On Monday, Mr. Sunday Faleye, the recently appointed commissioner of police for Osun State, declared there would be no safe havens for criminals while he was in charge.

Faleye then urged criminals residing in the state to leave right now during his first interview with journalists in Osogbo.

The police chief, who was born in Ekiti, also warned interstate offenders traveling to Osun that they would not be spared and declared that the Command will stop at nothing to reduce crime.

The command, he declared, “will take the fight to the criminals, including kidnappers, cult members, drug traffickers, and indeed, to their sponsors, procurers, counselors, and accessories both inside and outside the State.

“Under my leadership, Osun State would be a no-go zone for criminals because there will be no favourable A Federal High Court in Abuja denied on Monday an application by a part of the Action Alliance to halt the certificate forgery case brought against Asiwaju Bola Tinubu, the APC presidential candidate.

The court denied the attempt of the Adekunle Omo-Aje-led Tinubu support group to be included as an interested party in the defense of Tinubu in the certificate forgery case that the AA party had filed against him.

,,,,,In his decision on Omo-Aje and his faction’s request for joinder, Justice Obiora Egwuatu dismissed the motion on the grounds that the prerequisites for such joinder had not been made available to the court.

Justice Egwuatu ruled, among other things, that Omo-Aje failed to prove his claim to be the National Chairman of the AA and failed to explain how his interests would be jeopardized if he were not included as a defendant in the lawsuit.

While rejecting the joinder plea, Justice Egwuatu stated that the organization continues to be an obtrusive intrusive and busy body until their interests that are likely to be impacted are established.

Adekunle Omo-Aje and Ambassador Suleiman Abdumalik, who submitted the joinder application on behalf of their group, were found to have violated the requirements for joining, according to Justice Egwuatu’s decision.

The judge further ruled that they had failed to establish any sort of case to persuade the court to side with them.

The factional group had asked for the dismissal of the lawsuit against the APC and Tinubu in the joinder motion on the grounds that they (as party officers) had not authorized it to be filed in the name or on behalf of the party.

The judge then gave the plaintiff (AA) till Friday, November 4, 2022 to present its case about Tinubu’s alleged certificate falsification.

…..In order for the court to decide the case within the allotted legal time, Justice Egwuatu particularly ordered that any witnesses in the case be produced before the court.

In the lawsuit, the Action Alliance Party is requesting that Tinubu be disqualified from the 2023 elections due to an alleged certificate fraud.

On June 21, the party had petitioned the court to enjoin the Independent National Electoral Commission from inserting the All Progressives Congress’ name on the ballot for the 2023 presidential election.

The party said that the APC and Bola Tinubu, its presidential candidate, are unable to run in the 2023 presidential election due to alleged forgery Tinubu perpetrated in 1999 in the Writ of Summons marked: FHC/ABJ/CS/954/2022.

The lawsuit was filed on behalf of the plaintiff by its attorney, Mr. Upkai Ukairo, and alleged that Tinubu had submitted a falsified copy of his University of Chicago diploma in order to qualify for the 1999 Lagos State governorship race, which Tinubu ultimately won.

…..The Independent National Electoral Commission, the APC, and Senator Bola Tinubu were named as the first, second, and third defendants in the action, which was dated and filed on June 21.
